These terms govern your use of MyMoney NDIS Services. Please read them carefully to understand your rights and responsibilities.

Agreement to Terms

By using MyMoney NDIS Services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

1. Our Services

Plan Management Services

MyMoney provides NDIS plan management services including budget tracking, payment processing, compliance monitoring, and financial reporting. We act as your plan manager under the NDIS framework.

Platform Access

We provide access to our web-based platform and mobile applications that allow you to manage your NDIS plan, track spending, connect with service providers, and monitor goal progress.

Support Services

We offer customer support, accessibility assistance, and guidance to help you make the most of your NDIS funding and achieve your goals.

2. Your Responsibilities

Accurate Information

  • Provide accurate and complete information when setting up your account
  • Keep your NDIS plan and personal information up to date
  • Notify us promptly of any changes to your circumstances

Account Security

  • Maintain the confidentiality of your login credentials
  • Use strong, unique passwords and enable two-factor authentication
  • Notify us immediately of any unauthorized access to your account

Lawful Use

  • Use our services only for lawful purposes and in accordance with NDIS guidelines
  • Do not attempt to circumvent security measures or access unauthorized areas
  • Respect the intellectual property rights of MyMoney and third parties

3. Fees and Payment

Plan Management Fees

Our plan management fees are paid directly from your NDIS plan management budget. We operate under the NDIS price guide and do not charge additional fees beyond what's allocated in your plan.

Premium Features

Some advanced features may require additional payment. These optional services will be clearly marked, and you'll be informed of any charges before they're applied to your account.

Payment Processing

We process payments to service providers on your behalf using secure, NDIS-compliant payment systems. All transactions are recorded and available for your review.

4. Service Limitations

Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted access to our services. Scheduled maintenance and unexpected outages may occur.

Third-Party Services

We are not responsible for the quality or availability of services provided by third-party NDIS service providers. We facilitate connections but do not directly control service delivery.

Data Accuracy

While we take care to ensure data accuracy, you are responsible for reviewing and verifying all information, transactions, and reports generated by our platform.

5. Account Termination

Your Right to Terminate

You may terminate your account at any time by providing 30 days' written notice. We will assist with the transition of your plan management to another provider if required.

We may terminate your account if you breach these terms, engage in fraudulent activity, or if we're unable to continue providing services due to regulatory or business reasons. We'll provide reasonable notice when possible.

Data Retention

Upon termination, we'll retain your data as required by NDIS regulations and Australian law. You can request a copy of your data before account closure.

6. Limitation of Liability

Important Legal Notice:

To the maximum extent permitted by Australian law, MyMoney's liability is limited to the amount paid by you for our services in the 12 months preceding any claim. We exclude liability for indirect, consequential, or punitive damages.

This limitation does not apply to liability that cannot be excluded under Australian Consumer Law, including guarantees about the quality and fitness for purpose of our services.

7. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will:

  • Notify you at least 30 days before any material changes take effect
  • Post the updated terms on our website with a clear indication of what has changed
  • Send you an email notification if you have an active account
  • Allow you to terminate your account if you don't agree with the changes

8. Governing Law and Disputes

Governing Law

These terms are governed by the laws of Victoria, Australia, and you agree to submit to the exclusive jurisdiction of the Victorian courts.

Dispute Resolution

Before initiating legal proceedings, we encourage you to contact our customer service team to resolve any disputes. We're committed to working with you to find a fair solution.
